Terms of Service

1. Your Responsibility

You are responsible for how you use your agent. This includes:

• Listing changes, pricing decisions, or business moves based on your agent's advice
• Content your agent generates (titles, descriptions, tags, keywords)
• Research results and competitive analysis your agent provides
• Any actions taken on your Etsy shop based on your agent's recommendations

We provide the intelligence. You make the final call.

2. What We Provide

OpenSeller gives you:

• A private AI agent trained on Etsy commerce
• Trend research, listing analysis, and competitive intelligence
• Scheduled tasks and automated monitoring for your shop
• Secure storage for your shop data and agent memory

Features may change, improve, or be added as we grow.

3. What We Don't Guarantee

We do NOT guarantee:

• 100% uptime (we target high availability but outages happen)
• Perfect accuracy (AI makes mistakes — always verify before acting)
• That following your agent's advice will increase your sales
• Data persistence forever (back up anything critical to you)
• Specific Etsy API availability (Etsy can change their API at any time)

4. No Liability

We are not liable for:

• Business decisions you make based on your agent's recommendations
• Revenue changes, lost sales, or listing performance
• Etsy policy violations from content your agent generates
• Account suspensions on any third-party platform
• Data loss, service interruptions, or bugs
• Any indirect, incidental, or consequential damages

Maximum liability: the amount you paid for your subscription in the last 30 days.

5. Your Etsy Data

Important:

• We access your Etsy data only through Etsy's official API with your permission
• We never store your Etsy password
• You can revoke access at any time through your Etsy account settings
• Your shop data is used solely to power your agent — never shared with other users
• We do not sell your data. Period.

6. Acceptable Use

Don't:

• Use OpenSeller for anything illegal
• Attempt to hack, exploit, or reverse-engineer the system
• Resell or share access to your agent
• Use it to manipulate reviews, fake sales, or violate Etsy's terms
• Spam, harass, or harm other sellers
• Attempt to extract or scrape other sellers' private data

If you do, we'll suspend your account without refund.

7. Data & Privacy

• Your agent's memory and data are isolated to your account
• Your conversations and shop data are private
• We don't read your data unless you ask us to help debug something
• We collect anonymous usage metrics (error rates, feature usage, performance)
• You can request deletion of all your data at any time

8. Storage & Usage Limits

• Each plan has storage and usage limits
• If you exceed your plan's limits, we'll notify you before restricting access
• Upgrading your plan immediately increases your limits
• Downgrading may require data cleanup if you exceed the lower tier's limits

9. Payment & Refunds

• Subscriptions are billed monthly
• You can cancel anytime — access continues through the end of your billing period
• No partial-month refunds for cancellation
• If we screw up (extended outage, billing error), we'll make it right
• If we shut down the service, you get a prorated refund for unused time

10. Changes

We can:

• Add, change, or remove features
• Change pricing with 30 days notice
• Update these terms (you'll be notified by email)
• Discontinue the service (with refunds for unused time)

11. Termination

You can cancel anytime. We can suspend or terminate your account if:

• You violate these terms
• You abuse the system or other users
• Your payment fails after reasonable attempts to collect

12. The Legal Stuff

• AS-IS: The service is provided "as-is" without warranties of any kind.
• Governing Law: State of Oklahoma, United States.
• Severability: If any part of these terms is unenforceable, the rest still applies.
• Disputes: We'll try to resolve things like adults first. If that fails, binding arbitration in Oklahoma.
